This expert opinion provides a strong legal foundation for enforcing Circalle’s design rights in Sweden and is persuasive evidence of the Nova C Double Back’s originality in other EU Member States.
Unauthorised reproduction, manufacture, or distribution of the Nova C Double Back may infringe copyright in Sweden and could give rise to civil remedies, including injunctions, seizure, recall, or destruction of infringing goods and claims for damages or an account of profits. A business that knowingly produces, sells or resells unauthorised copies faces increased legal risk; an innocent business purchaser may still be subject to civil remedies (which courts may mitigate in cases of good faith).
Circalle recommends that customers, specifiers, and procurement authorities rely on authorised channels and genuine products when selecting seating for regulated or public installations (for example, airports and transport hubs), as unauthorised copies may not carry warranties, spare parts, manufacturer support, or the required safety and certification standards.
